How this is worked out

How the Board's scale turns your figures into a fee.

Step by step

  1. Pick the service. Each has its own scale in the Seventh Schedule of the Valuers, Appraisers and Estate Agents Rules 1986, as amended from 1 October 2009.
  2. Selling or buying: up to 3% of the price, at least RM1,000 per property. Letting: up to 1.25, 1.50 or 1.75 months' rent by tenancy length, at least one month's rent. A rent review is half the letting fee.
  3. Valuation and property management: the value or rent is split into bands, and each band is charged at its own rate (tables below). Each scale has a minimum fee.
  4. Every figure in the scale is a maximum (rule 48(1)). Between the minimum and the maximum, the fee is agreed with the firm. More is allowed only with the Board's written consent.
  5. The fee is worked out exactly and rounded once, to the sen, so the band lines (each rounded for display) may differ from it by a sen. Service tax is added on the rounded fee: 8% for services from 1 March 2024, 6% from 1 September 2018 to 29 February 2024.

Assumptions

  • Fees are worked on the price, rent or value you enter. For a valuation, the valuer's own figure may differ.
  • The 3% is taken of the sale price. The scale says '3%' without naming the base.
  • Tenancy length means the fixed term, without renewal options.
  • Over 5 years with a renewal option, each option year adds 0.25 month (our reading). The other reading, each year of the fixed term beyond 5, is shown beside it.
  • Service tax is added on top of the scale fee, at the rate for the date the service is provided. For a service that straddles 1 March 2024, the invoice may split 6% and 8%.
  • One property per calculation. Under rule 48(2) the bands apply to the total under one instruction, so ask the firm how it treats several properties.

Exemptions and special conditions

  • Developer projects: the fee for selling or marketing a project is agreed between the agent and the developer. No scale applies.
  • A property outside Malaysia, or a Malaysian property sold abroad: the scale does not apply.
  • Serviced offices and serviced apartments: the letting scale does not apply. Whether this covers strata serviced apartments is not settled.
  • Tenancies under one year: the fee may be pro-rated.
  • Update valuation (item 5A) and revaluation (item 5B): at least 15% or 30% of the scale fee, or RM400 if higher.
  • Retrospective valuation (item 5C): up to 10 times the scale fee, by negotiation, for a date at least 5 years back; not for land acquisition. RPGT on a property bought before 2000 uses its value on 1 January 2000.
  • Land acquisition (item 1): a fee set by the award, paid by the Land Administrator on your compensation claim.
  • The same scale applies to citizens, foreigners and companies.
  • Only the party who appointed the agent pays. An agent may not charge both sides (rule 89).
  • Only a firm registered with the Board can charge and recover these fees.
  • No commission from third parties, such as a lawyer's referral fee, without your knowledge and written consent (rule 90).
  • A valuation fee may not depend on the result (rule 67).
  • The agency fee is due when the SPA or tenancy agreement is signed (Board FAQ). Agree the terms in writing.
  • Tenancy agreements are prepared by lawyers, not agents. Their stamp duty is in the tenancy stamp duty calculator.
  • Extra claims need your prior agreement: expenses actually incurred, travel where the property is more than 40 km from the office, and advertising. Valuers may also charge RM150 an hour or RM800 a day for meetings, and RM200 an hour or RM1,000 a day for giving evidence.
