Malaysia's tax authority: official rules, rates and exemptions for real property gains tax (RPGT), and its guidance on stamp duty.

RPGT is self-assessed for disposals since 1 January 2025: the return is due within 60 days of the disposal. The once-in-a-lifetime home exemption, for citizens and permanent residents, is elected on Form CKHT 3 and cannot be withdrawn.

HASiL's online portal: sellers and buyers file RPGT forms through e-CKHT (compulsory since 1 January 2025), and documents are stamped through e-Duti Setem.

You need a Tax Identification Number (TIN) and a MyTax login. Without a TIN, register through e-Daftar on MyTax first.

Stamp a tenancy agreement online and pay the duty. Tenancy agreements are self-assessed since 1 January 2026, and property transfers that do not need a JPPH valuation from 1 January 2027; you log in through MyTax.

HASiL has no public tenancy calculator, so our calculator gives an estimate and e-Duti Setem gives the actual duty. A claim for an exemption or remission is formally assessed by HASiL, not self-assessed.

Valuation and stamp duty

The government's valuation department: it values property for purposes such as stamp duty on transfers, and you can check the status of a stamp duty case online.

Most inner pages, including the FAQ, are in Malay. The status check asks for the purchaser's MyKad, passport or company registration number, or the adjudication number.

Agent and valuer fees

The Board that registers estate agents and valuers publishes the official scale of fees (for a sale, a maximum fee of 3%, minimum RM1,000), and you can check that an agent is registered.

The scale is a maximum, and the actual fee is agreed with the agent. It does not apply to foreign properties sold in Malaysia or Malaysian properties sold abroad, and project sales are by agreement.

The body for lawyers in Peninsular Malaysia: find a lawyer for your purchase, sale or tenancy, and read the Solicitors' Remuneration Order 2023, which sets conveyancing scale fees.

For a property in Sabah or Sarawak, ask your lawyer which rules apply. A lawyer may discount some scale fees by up to 25%.
